What makes sense in a divorce: a mediator or a lawyer?

Basically, both the mediator and a lawyer are both professional service providers for conflict resolution, but with different approaches.

Neutrality and Impartiality in Conflict Resolution and Problem Solving

A mediator is a third person, strictly committed to neutrality and impartiality, who helps mediate and resolve conflicts between two (or more) parties. The mediator helps the parties communicate their interests and needs and work together to find a solution. The mediator promotes communication and understanding between the parties in order to ideally find a win-win solution.

Advocating and Strategizing to Safeguard Interests

The lawyer is a legal expert who represents the interests of a party in a legal dispute. The lawyer advises her client, analyses the legal situation, develops a strategy and represents her client’s interests in court. The focus is on asserting a party’s rights and interests within the legal framework.

Sustainable Conflict Resolution in Case of a Divorce

In a divorce case, a mediator is usually more useful because the parties, especially if they have children together, are interested in a long-term amicable relationship. Mediation is about finding a solution in the interest of both parties and not about one party winning over the other.
